Former Queens Library chief Thomas Galante, who was fired two years ago for “inappropriate” spending was just give $300,000 by the city without a trial after he sued for illegal termination.
Only in New York City would a man who used more than $250,000 in public funds on “inappropriate” expenses be rewarded with a $300,000 windfall and be protected from paying back the money he used.
City officials, have agreed to just that deal with Queens Library president Thomas Galante, who got canned for his actions and then sued the city for violating his contract. The city caved and paid out the money. The library has agreed to settle Galante’s severance suit for $1.5 million, most of which will go to legal fees, except for $300,000 that he will pocket.
An audit by the city Comptroller’s Office found that he racked up roughly $260,000 in “inappropriate” expenses on his library-issued credit cards over two years including for food, booze, casino trips and concert tickets.
Nevertheless, Galante filed suit last year in Brooklyn federal court after he was terminated in December 2014, claiming he was due severance pay under his contract because he was not fired for cause. But even though the library argued that he was indeed fired for cause, it decided not to fight Galante in court.
“It’s in the best interest of this institution and the public to put our time and resources towards our future, rather than litigate this matter to conclusion,” said Queens Library President Dennis M. Walcott, who once famously ran the Department of Education under Mayor Mike Bloomberg.
Of the total settlement, Galante will receive $300,000 representing “lost wages sought by him in the lawsuit or allegedly incurred by him in connection with the termination of his employment,” the agreement says.
The remaining $1.2 million will go toward his attorney’s fees. In September, a federal judge ordered that the library was responsible for paying for Galante’s defense.
Galante also has to return all library property, including an HP Envy desktop, an iPad and an iPhone.
Galante, who worked at the library for 27 years, has previously said the questionable expenses were to benefit the library.
The money went toward nearly $2,000 for Maroon 5 concert tickets and $22,800 in furniture for his office and a new smoking deck. He and other library officials also spent $22,800 on an “executive retreat” in Connecticut, including $360 Galante spent on booze, the audit said.
Multiple charges for gasoline were also found on Galante’s credit card, suggesting that cars other than his were filled up.
“We’re pleased with this. This enables Mr. Galante to get on with his life and to have this chapter resolved,” his lawyer, Thomas Rohback told the New York Post.
